About the Team

Working collaboratively and proactively with external economic advisors, the team regularly provides pragmatic and time-

critical advice to manage and minimise the impact of the regulatory process upon the deal timetable. Our team successfully works with clients providing legal advice on the full range of competition and trade issues including :

  • Merger Control
  • IP / Competition law interface
  • Investigations into suspected competition law infringements
  • Arbitration
  • Co-operative arrangements and strategic alliances
  • Competition law compliance
  • Voluntary disclosure
  • Highlights of the team's recent and current work includes :

  • Advising a manufacturer of construction inputs in relation to a dawn raid conducted by the Office of Fair Trading under its civil and criminal investigatory powers;
  • Acting for a French-based manufacturer in defending a follow-on action for damages arising from European Commissions infringement decision in relation to the animal feed phosphates cartel;
  • Acting for Thai Airways in the Air Cargo damages case;
  • Acting for Inverness Medical Innovations, Inc. (now Alere, Inc.) obtaining merger clearance worldwide in respect of the global consumer diagnostics joint venture with Proctor & Gamble;
  • Advising a global provider of post-trade financial services in relation to the application to a planned JV of various merger control regimes worldwide, including the EU regime and the regimes of EU Member States;
  • Advising SITA in obtaining European Commission clearance of a joint venture with Airbus to develop and market in-flight passenger's communications services;
  • Advising a manufacturer of aircraft seating in relation to antitrust issues arising in the context of a patent litigation action before the High Court.
  • Team members are based in both London and Birmingham and work closely with each other and with colleagues in other firm practice areas.
  • Main Purpose of the Job

    Working in a team of specialist lawyers advising on a broad range of EU, Trade and Competition law issues.

    Main Duties and Responsibilities

    Taking an active role in a well-regarded award winning team advising clients such as Thai Airways, Dixons, Carphone Warehouse, Interdigital, Seiko Epson, Beiersdorf, Beckman Coulter, various originator pharmaceutical companies including Eisai, Convatec, Origin / Masstock, Foseco, ProStrakan, Nissan, Aston Martin, Tarmac, Society of Motor Manufacturers and Traders on issues such as :

  • Merger control notifications and advice, including structuring transactions to reduce regulatory risks and obtaining merger clearances;
  • Antitrust litigation (follow on / stand-alone damages claims / defences CAT and High Court);
  • Cartels and dawn raids;
  • FRAND and standards issues;
  • Anti-competitive behaviour (including disputes);
  • Competition law compliance (UK and EU);
  • Complaints to and investigations by the European Commission, CMA and other regulatory authorities;
  • Distribution, agency and licensing agreements EU regulatory issues, and free movement; and
  • Sanctions;
  • Trade defence instruments
  • Key skills and experience

    Working in an inclusive, sharing and collaborative culture, you will be expected to play your part in ensuring the continuing success and growth of the team.

    We would look for the successful applicant to be a qualified solicitor who has :

  • Experience of advising clients on : merger control, other antitrust issues, including compliance, cartels, litigation and a solid grounding in EU law;
  • Experience of establishing and developing relationships with and obtaining instructions from clients through provision of excellent service and / or formal marketing initiatives.
  • We would look for the successful applicant to have :

  • Passion for the subject of EU and competition law;
  • Demonstrably sound technical grasp of EU / competition law legal issues in particular in relation to the IP / competition interface;
  • Highly motivated, excellent analytical and presentational skills;
  • Strong oral and written communication skills;
  • Language skills (French or German language is desirable);
  • Commercial awareness and common sense;
  • Willingness to engage in business development and marketing initiatives;
  • Ability to work well in a team;
  • Post graduate qualification in EU / competition law (desirable); and
  • Grounding in economics (desirable).
